Battista’s and Stage Door file lawsuit over Las Vegas Grand Prix

The owner of several small businesses has filed a lawsuit accusing the Las Vegas Grand Prix of unfairly interfering with their business operations.

The limited liability company that owns Battista’s Restaurant and Stage Door, both located at the rear of Flamingo and Cromwell, filed the lawsuit against Clark County and Grand Prix in U.S. District Court on Tuesday.

“Stage Door lost most of the loyal customer base it had built up over the past fifty years due to the construction of Formula 1,” the lawsuit states.

Neither company was ever notified that the racetrack would be built right next to them on Flamingo Road, the lawsuit states, and they were never given the opportunity to object.

They also claim that Formula 1 was never granted a special permit for the race, which started last autumn.

Battista’s and Stage Door rely on foot traffic around the resort for their businesses, the lawsuit says, but construction of the F1 circuit “was unpredictable and extremely disruptive.” Construction of a bridge for Flamingo Road over Koval Lane also closed the intersection for several days. It wasn’t removed until February of this year.

“The overall F1 construction made it difficult, if not impossible, for employees and guests to access Stage Door and Battista’s for the majority of 2023,” the lawsuit states. “At various times, all access to Stage Door and Battista’s was completely blocked off.”

Workers had to add several hours to their travel time because of traffic or changes in bus routes, the lawsuit alleges, and some vendors and suppliers ultimately refused to deliver. The lawsuit alleges the companies will suffer more harm at future Grand Prix races.

Lawyers allege that F1 wrongfully interfered with their business and violated their rights to due process and equal protection. They are seeking damages for actual and punitive damages, plus interest.

The Las Vegas Grand Prix says it does not comment on pending litigation.

Ellis Island Casino filed a similar lawsuit in MayBoth Clark County and Grand Prix have filed motions to dismiss and a hearing is scheduled for Thursday.
